Your Rights under New York Health
Insurance Law

If you are an individual seeking New York health insurance for
yourself or family, you cannot be turned down for health reasons
or pre-existing conditions. New York health insurance companies
cannot charge you more if you have pre-existing conditions or
because of your age, gender or status. This limits the number of
Insurance companies willing to offer New York State health insurance.
The rates are high for those remaining because of the cost to
cover the high risk individuals. This is in contrast to states
that provide other methods for insuring high risk individuals.
If you are considered low income you may qualify for New York health insurance with one of several programs available.

The New York Medicaid program provides free coverage for low income
families with children, elderly, disabled and pregnant
women.

cost New York Health Insurance to uninsured working
individuals and small business owners.

The New York Family Health Plus program provides either free or
subsidized New York
health insurance for uninsured children and eligible

Your New York Health
Insurance policy cannot be cancelled because you get sick. New
York Health Insurance companies must renew your policy as long
as the premium payments are paid up to date and the questions on
the original application were answered truthfully.
Group health
insurance in New York must accept all pre-existing medical
conditions with the following provisions. A New York Health
Insurance Company can impose up to an 18 month waiting period
for pre-existing medical conditions if the employee was not
previously covered under another plan within the previous 63 day
period. If a pre-existing condition was diagnosed or treated
within the “Look Back Period” (6 months) the New York health
insurance companies can impose up to a one year exclusion period
for that condition. As per the Federal HIPAA act of 1996, groups
of 20 or more employees must provide New York health insurance
through the COBRA program to separated employees or dependents
of employees if divorce or death occurs. You cannot be
charged more than 2% higher than the actual premium for the
COBRA coverage. No pre-existing exclusion period can be applied
by a New York health insurance provider without appropriate
written notice.
Newborn children and
legally adopted children must be covered for the first 31 days
under either the father's or mother's New York health insurance
policy as per federal law. Coverage will not continue if the
child was not added to the policy by the parent prior to the 31
days expiring. Because of this, New York Health Insurance
companies offering individual health insurance policies will not
cover an expectant parent even though they may not be married or
the New York health insurance company does not include
maternity.

Why Should You Buy New York
Health Insurance?
The cost of
health care has risen drastically over the past few decades. If
you do not have New York medical insurance to help pay
bills, a serious injury or illness can be financially

occurring around the country offering coverage for $50 to
$130 to cover the whole family. Don’t get caught in a scam.
If its too good to be true, its too good to be true.

When you buy an New York Health Insurance policy, make the
check payable to the company, not the agent. Always pay by
check or money order, and write your policy number on the
payment. Do not give the agent your bank account number for
automatic withdrawals until you have verified the agent and

information.
Tips for Avoiding
Fraudulent New York Health Insurance Plans

The best tool for avoiding fraud is your phone. Call your New
York
Health insurance department and find out whether the
insurance agent and New York Health Insurance company
are licensed in the state.

Fraudulent plans are most often sold through direct mail
solicitations, fax, radio ads or over the Internet, so be
especially wary when responding to these solicitations.

If an New York Health Insurance policy costs far less than
what other companies are charging, this could be a warning
sign. It’s a good thing to comparison shop, but if a policy
is significantly cheaper, beware. If it sounds too good to
be true, it probably is.

Beware of an New York Health Insurance agent or company that:

Refuses to provide proof of state licensure.

Insists on cash payments or automatic withdrawal.

States this is a “one-time deal” or your “last chance
for special savings.”

Boasts that the coverage is available to anyone,
regardless of history or risk.

Verbally
states something is covered without showing you the
details in a company publication.

Tells you no
other company provides this coverage or that the only
other company is much more expensive.

Tells you
they can sell you any company but only has company
publications for one company.
